Open Season

These Terms of Service (“Terms”) are an agreement between you and Piece & Quiet, LLC (“Company,” “we,” “us”), the operator of the Open Season mobile application and the website osdatesanddraws.com (together, “the Service”). By downloading, purchasing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Open Season compiles U.S. hunting season dates, tag and permit application windows, draw deadlines, and regulation summaries from publicly available state wildlife-agency sources, and sends optional reminders about dates you choose to follow. The Service is an informational aid only.
The Service is not a legal authority and is not legal advice. Season dates, deadlines, and regulations may contain errors, may be incomplete, and may become outdated without notice. State agencies can change dates and rules at any time. You must confirm all dates, rules, and license requirements with the official state wildlife agency before hunting, purchasing a license, or applying for a tag or permit. You are solely responsible for complying with all applicable laws and regulations wherever you hunt.
Push notifications are delivered on a best-effort basis and depend on your device settings, network conditions, and third-party delivery services. Notifications may be delayed or may not arrive. Do not rely on the Service as your only means of tracking a season date or application deadline. We are not responsible for missed openers, missed deadlines, unsuccessful applications, or any other consequence of a notification that was not sent, delivered, or seen.
Hunting is a regulated and inherently dangerous activity. You are solely responsible for your own safety, licensure, and legal compliance, including where, when, what, and how you hunt. The Service does not verify your eligibility, licensure, or the legality of any specific hunt for you.
The app is sold as a one-time purchase through the Apple App Store or Google Play. Billing, receipts, and refunds are handled by the store you purchased from, under that store’s terms. Where required, Apple’s standard Licensed Application End User License Agreement applies to App Store copies, and these Terms supplement it.
If you submit content to the Service (for example, a report that a date looks wrong), you grant us a perpetual, royalty-free license to use it to operate and improve the Service. Your personal tracker entries and notes remain yours and are handled as described in our Privacy Policy.
The Service links to third-party sites, including official state licensing and application portals. Those sites are not ours; we are not responsible for their content, availability, or your transactions with them.
The Service’s software, design, branding, and compiled presentation are owned by Piece & Quiet, LLC. Underlying government season dates and regulations are public information; our compilation, summaries, and presentation of them are not.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, TIMELINESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR CURRENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PIECE & QUIET, LLC AND ITS MEMBERS, OFFICERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS ARISING FROM YOUR RELIANCE ON INFORMATION IN THE SERVICE — INCLUDING MISSED SEASONS OR DEADLINES, DENIED OR UNSUCCESSFUL APPLICATIONS, CITATIONS, FINES, LICENSE REVOCATIONS, PROPERTY DAMAGE, OR PERSONAL INJURY. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
You agree to indemnify and hold harmless Piece & Quiet, LLC from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms, your violation of any law or regulation while hunting, or your misuse of the Service.
We may modify or discontinue features of the Service, and may update these Terms; material changes will be reflected by a new effective date above, and continued use of the Service after a change constitutes acceptance. We may suspend or terminate access for violation of these Terms.
These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Georgia, and you consent to their jurisdiction.
